General Terms and Conditions for Consumers (B2C) for Distance Selling and Delivery
Effective Date: October 2024

1. Scope

Upon entering into a contract, these General Terms and Conditions (GTC) in their version valid at the time of the contract conclusion shall apply to all mutual claims between the customer and BUGSLOCK GmbH, hereinafter referred to as "Bugslock Austria."

2. Contractual Partner

Orders via www.buddycare.eu are only available to individuals with a residence or habitual domicile within the EU. Bugslock Austria enters into contracts with fully legally competent natural persons who have reached the age of 18 (hereinafter referred to as "Customer"). Registration on the website is required.

3. Conclusion of Contract

The contract is concluded when the customer submits an order and Bugslock Austria accepts it. An automated order confirmation does not constitute acceptance of the contract. The contract becomes effective only upon the actual delivery of the goods.

4. Right of Withdrawal and Return Conditions (Cancellation Policy)

4.1. Right of Withdrawal

The customer has the right to withdraw from the contract within 14 days without providing any reason. The period begins on the day the customer or a third party named by them takes possession of the goods. To exercise the right of withdrawal, the customer must notify Bugslock Austria through a clear statement (e.g., by post or email). The provided withdrawal form can be used but is not mandatory.

4.2. Consequences of Withdrawal

Bugslock Austria will refund all payments received, including delivery costs (except for additional costs for different delivery methods), immediately and no later than 14 days from receiving the withdrawal notice. Refunds will be made using the same payment method as the original transaction unless otherwise agreed.

4.3. Return and Return Costs

The customer bears the direct costs of returning the goods. Mailable goods should be sent sufficiently postage-paid to:

Insufficiently paid returns will be charged to the customer. Bugslock Austria will bear the return costs only in cases of incorrect or defective deliveries.

5. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to customer specifications or clearly tailored to personal needs.
  • Goods that are sealed and are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
  • Digital content not delivered on a physical data carrier, if the delivery has begun with the customer's express consent before the withdrawal period has ended.

6. Examination of Goods – Compensation for Diminished Value

The customer may inspect the goods as is customary in a retail store. The customer is liable for any reduction in value due to use beyond what is necessary to check the condition, properties, or functionality of the goods.

7. Availability Reservation

If the ordered goods are unavailable, Bugslock Austria reserves the right to offer an equivalent alternative or withdraw from the contract. Payments already made will be refunded immediately.

8. Delivery Time and Risk Transfer

Delivery will occur within 3 days after receipt of payment. The risk of loss or damage to the goods passes to the customer or a third party appointed by them only upon handover.

9. Shipping and Delivery Costs

Shipping costs are shown in the shopping cart. For orders with a value of €29 (Austria) or €99 (EU/CH), shipping is free of charge.

10. Prices

All prices on www.buddycare.eu are final prices, including VAT. The price displayed in the shopping cart at the time of the order is binding.

11. Payment

The customer can choose from the following payment methods:

  • SEPA bank transfer
  • Mollie (various options)
  • PayPal
  • EPS
  • Credit/debit card
    Payment must be made in advance before the goods are shipped.

12. Retention of Title

The goods remain the property of Bugslock Austria until full payment is made.

13. Warranty and Manufacturer's Guarantee

The warranty period is 24 months from the date of delivery. Manufacturer guarantees must be claimed directly with the manufacturer.

14. Liability

Bugslock Austria is liable only for intent and gross negligence. This exclusion does not apply to personal injury or damage under the Product Liability Act.

15. Data Protection

Data processing is carried out in accordance with the General Data Protection Regulation (GDPR). A detailed privacy policy is available on the website.

16. Jurisdiction and Applicable Law

Austrian law applies. Jurisdiction is determined by the consumer's residence.

17. Severability Clause

If any provision of these GTC is found to be invalid, the remainder of the contract shall remain unaffected.
